1 General Condition of on-line sales of APARA

The giving conditions of sales are concluded by the company of SAS APARA, whose registered office is at 3, Place Jean NOUZILLE 14000 CAEN, - SIRET 830341723 00013 -  registered under the number of 3213Z in the Register of Trades and Companies of Caen, hereinafter refered to as "seller", and, any natural or legal person wishing to make a purchase via the website hereinafter "buyer".


These conditions of sale define the contractual relationship between the buyer and APARA, and these conditions apply to all purchases of buyers made through the merchant site of APARA, either professional or individual consumer. The acquisition of a product or service through this site implies buyer’s total acceptance of these conditions of sale. These conditions shall prevail over any other general or special conditions which are not specifically approved by APARA. Our company reserves the right to modify terms and conditions at any time. In this case, the conditions will be those in force at the date of the buyer’s order.


The products offered are those listed in the catalog published on the site of APARA. These products are offered subject to availability. Each product is accompanied by a description provided by the supplier. The photographs in the catalog are as accurate as possible but can not ensure a perfect similarity.


The prices listed in the catalog are priced in euros taking into account the applicable VAT rate on the date of the order ; any rate change will be reflected in the price of products. APARA reserves the right to change prices at any time, except that the price listed in the catalog on the day of the order shall be applicable only to the buyer.


The online sale of products appearing in this site is intended for all purchasers who resident in countries that fully authorize these products to enter into their territory.


The buyer, who wishes to buy a product must :

- Fill in the form of identification which shows all the data requested or giving the customer number if there is any.
- Complete the online order form giving all references to chosen products or services.
- Validate the order after reviewing it.
- Make payment as provided.
- Confirm the order and payment.

Confirmation of the order implies acceptance of these conditions of sale, in recognition of having perfect knowledge and waiver of its own conditions of purchase or other conditions. All data recorded and confirmed are proof of the transaction. The confirmation means signing and acceptance of the transactions. The seller will email the confirmation of the order recorded.


The price is payable to the order. Payments will be made by a PayPal account and by credit card; they will be realized through the secure system that uses ''SSL Secure Socket Layer'' so that the information transmitted is encrypted by software and no third party can read it during transit on the network. The buyer's account will be debited on dispatch of available products and the amount of goods sent. At the request of the buyer, a paper invoice showing VAT will sent.


- Deliveries are made to the address specified in the order.
The risks are borne by the purchaser at the time the goods have left the premises of APARA. In case of damage during transportation, complaint must be made with the carrier within three days of delivery. Delivery times are for illustrative purposes only; if they exceed thirty days from the order, the contract may be terminated and the buyer will be refunded. Orders are shipped to consumers by Tracking Collissimo, which allows, through us, to trace the parcel if it fails to get to the buyer. The goods is to be delivered to buyer’s home by postman and a delivery note is to be signed by the buyer. In the absence of the buyer, he will receive a notice of his postman, which allows him to withdraw the products in the nearest post office for a period designated by the postal services. The buyer is responsible for checking in the presence of the post officer or the deliveryman, the state of the packaging of the goods and the content delivered.

- As to professionals, their orders are processed in Ex Works, our own logistics. Once finished production, APARA will transfer the packed goods to the logistics. They will send an email to the client indicating the weight and volume of the order. The customer must ensure all administrative procedures related to customs, as well as the payment of these taxes: declaration of goods to customs, issue the documents to customs for import and export, to finish the payment of taxes for import and export. The buyer then chooses the transportation: what kind of transportation, which companies, what transport "shuttle" (factory main transport), which main transportation, what types of insurance ... All products supplied by the seller have the legal guarantee provided by Article 1641 of the Civil Code. single link or hyperlink is strictly prohibited without the express or written consent of APARA agreement.


APARA undertakes to preserve the confidentiality of information provided by the user of this site, it can be sent to the company for the usage of certain services. Any information concerning is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the user has the right to access, modify and delete their information. APARA archives purchase orders and invoices on a reliable and durable copy in accordance with the provisions of Article 1348 of the Civil Code. The registers of APARA will be considered by the parties as proof of communications, orders, payments and transactions between buyer and seller.


These conditions of online sale are subject to French law. In case of dispute or litigation, the court in Caen will be able to hear.
